Se analiza una revisión tanto de la evolución del concepto de muerte cerebral fuera de nuestro país como de las principales directrices que las diferentes legislaciones extranjeras adoptan en el momento actual respecto a este problema.

La primera cuestión planteada se refiere al diagnóstico de muerte cerebral que cada vez de una manera más general tiende a establecerse por procedimientos exclusivamente clínicos. Las pruebas complementarias (EEG, estudios de flujo, potenciales evocados, etc.) parecen mantener una utilidad fundamentalmente como documentación del hecho de la muerte cerebral.

La segunda cuestión hace referencia a las disposiciones legales que cada país mantiene como necesarias para la comprobación de la muerte cerebral con vistas a la donación de órganos.

Bajo esta óptica se revisa la legislación española sobre el tema desde un punto de vista crítico, valorando posibles puntos quizá susceptibles de mayor clarificación en el futuro.

In our present work we revise how the concept of cerebral death has evolved outside the boundaries of our country, as well as the principal guidelines wich different foreign legislations have adopted in respect to this problem.

The first question is related to the diagnosis of cerebral death wich every time, more and more, in a general way, is being established exclusively by clinical means. The complementary tests (EEG, studies of flow, etc.) seem to maintain in the present moment a utility, fundamentally, as documentation of cerebral death.

The second question cieals with the legal aspects which every country maintains or considers necessary to be able to establish cerebral death with visions towards the donation of organs. Under this light we review the spanish law concerning this matter from a critica point of view pondering some points which may be susceptible to clarification in the near future.
